PAIA Manual

Manual in terms of Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) (“PAIA”).

1. Introduction

This manual is published by Ensite Technology Services (Pty) Ltd, registration number 2019/083202/07 (“Ensite”, “the Company”) in accordance with section 51 of the Promotion of Access to Information Act, 2000 (“PAIA”). Its purpose is to explain what records the Company holds, and how a member of the public can request access to those records.

Since 1 January 2022, every private body in South Africa — regardless of size — is required to have a PAIA manual. There is no exemption for small businesses.

4. Guide on how to use PAIA

The South African Human Rights Commission (SAHRC) has published a guide, as required by section 10 of PAIA, to assist people wishing to exercise their rights under the Act. This guide is available from the SAHRC:

5. Records held by Ensite

The table below describes the general categories of records Ensite holds. Records marked “available without a formal request” can simply be accessed on our website. All other categories require a formal PAIA request, as described in section 6 below.

6. How to request access to a record

A request for access to a record must be made using the prescribed form (Form 2, in terms of the PAIA Regulations), addressed to the Information Officer at the contact details in section 3.

A request should include:

  • Sufficient detail to enable the record to be located
  • The form of access required (for example, a copy or an inspection)
  • Confirmation of identity, and if requesting on behalf of someone else, proof of authorisation
  • Postal or email address for correspondence

Fees

A request fee of R50 is payable by requesters (other than personal requesters seeking their own personal information) in terms of the PAIA Regulations. Additional access/reproduction fees may apply depending on the format requested (for example, photocopies or electronic copies).

Response time

Ensite will respond to a valid request within 30 days, as required by PAIA, unless an extension applies in terms of the Act.

7. Grounds for refusal

PAIA allows certain records to be withheld in specific circumstances — for example, where disclosure would unreasonably disclose another person’s personal information, or would harm Ensite’s legitimate commercial interests. Any refusal will state the reasons and the requester’s right to appeal or approach the Information Regulator or a court.
